Offshore employees residing in the Netherlands

Since January 1, 2012 employees, living abroad, who work on the Dutch continental shelf, mostly in the oil and gas industry, are subject to the Dutch social security system. Thus, they can claim Dutch social security benefits, including the state pension (AOW). Previously the North Sea Mining Employment Act (WAMN) arranged this only partly. Employers were then only required to ensure workers for illness and disability, and for not more than two years. The WAMN is no longer applicable as of January 1, 2012 when the Act on Social Security Dutch Continental Shelf came into effect for all employees working on fixed installations on the Dutch continental shelf.

This legislation has implications for those who:

  • live abroad and are not socially insured in the Netherlands under EC Regulation 883/2004;
  • live in the Netherlands and work for a foreign employer.

January 1, 2013

As of January 1, 2013, self-employed persons living abroad and working on the Dutch Continental Shelf are insured under Dutch national social security legislation on the condition that they pay income tax in the Netherlands. This is stipulated by an amendment in a provision regarding the extension and restriction of  the circle of insured persons in connection with the Act on Social Security Dutch Continental Shelf (“Wet NCP”). As a result of the amendment this group of self-employed persons will be treated in the same way as self-employed persons working in the Netherlands in matters concerning the national social insurances. This is in line with the international tendency to no longer distinguish in social security between persons who are working onshore and persons who are working offshore.


Offshorepersoneel woonachtig in Nederland

In het buitenland woonachtige werknemers die op het Nederlands continentaal plat (NCP) werken, veelal in de olie- en gaswinningsindustrie, vallen sinds 1 januari 2012 onder het Nederlands sociale zekerheidsstelsel. Zij kunnen daarmee aanspraak maken op de Nederlandse volks- en werknemersverzekeringen, waaronder de AOW. Voorheen regelde de Wet arbeid mijnbouw Noordzee (WAMN) dit slechts ten dele. Die bood alleen bescherming bij ziekte en arbeidsongeschiktheid.

Werkgevers waren toen wettelijk verplicht in het buitenland woonachtige werknemers te verzekeren tegen ziekte en arbeidsongeschiktheid. Dat gold voor maximaal twee jaar en bood alleen bescherming bij ziekte en arbeidsongeschiktheid. De WAMN verviel toen het Nederlands sociaal zekerheidsstelsel per 1 januari 2012 voor alle werknemers op het NCP in werking trad.

Deze wetgeving heeft gevolgen voor hen die:

  • in het buitenland wonen en niet op grond van EG-Verordening 883/2004 in Nederland sociaal verzekerd zijn;
  • in Nederland wonen en werken voor een buitenlandse werkgever.

Met ingang van 1 januari 2013 zijn zelfstandigen die in het buitenland wonen en die werken op het Nederlands deel van het continentaal plat verzekerd voor de Nederlandse volksverzekeringen. Daarbij geldt de voorwaarde dat deze buitenlandse zelfstandigen in Nederland inkomstenbelasting betalen. Dit blijkt uit een wijzigingsbesluit in verband met de Wet sociale verzekeringen continentaal plat (Wet NCP). Met deze wijziging wordt deze groep zelfstandigen op gelijke wijze behandeld voor de volksverzekeringen als zelfstandigen die in Nederland werken. Dit past in de internationale tendens en om voor de sociale zekerheid niet langer onderscheid te maken tussen werken onshore (op het vasteland) of werken offshore (buitengaats).
